Section 8 Declaration of Continued Use

Sometime during the fifth year after federal trademark registration, the trademark owner must file a Section 8 Declaration of Continued Use declaring the continued use of the owner’s mark.  If an owner fails to timely file a Section 8 Declaration of Continued Use, federal trademark rights will be cancelled.
